So, I’m dealing with a pretty rough situation. Long story short, my mom quit claim deeded her house to me (we got it all on video with a notary, paperwork legit and filed with the county). The issue is, my mom was diagnosed with dementia by a nurse practitioner right before, but she’s not been declared incompetent, and she knew what she was doing. Now, my family is claiming I exploited her, but all the money from the house goes to her rent and care. Has anyone else been through something similar? What was the outcome?
Wow, that sounds complicated. Did a lawyer say anything about the dementia diagnosis? It sounds like it could be a big factor in your defense.

Yeah, exactly! Since a nurse practitioner diagnosed her, not a specialist, there’s no legal incompetency. So, it should stand up in court, I hope.

What’s a quit claim deed btw? Not super familiar with real estate stuff.
@Drew
Oh, it’s like a quick way to transfer property ownership. The person signs it over, no guarantees about the title’s history or condition, just says ‘it’s yours now’.
@Drew
Got it, thanks! I was confused too. So basically, you’re just transferring the title without any hassle.
If your mom wasn’t legally declared incompetent, then it seems like you have a solid defense. I’ve heard of similar cases where video evidence really helped.

Exactly, that’s what I’m hoping for! The video shows she’s fully aware of what she’s signing, so fingers crossed it clears things up.
It’s good that her financial manager is backing you up. That can go a long way in proving you did things by the book.

Totally! She’s got decades of experience and said I handled everything right. That’s gotta help my case, right?

For sure. Financial advisors with solid records are usually trusted in court. You’re probably in good hands with her support.
Are you nervous about October 31st? I can’t imagine how stressful it must be waiting for court.

Yeah, definitely. I haven’t even hired a lawyer yet, so I’m kinda scrambling. Just hoping I can get everything organized in time.

Good luck with everything, ABC. Sounds like you’re taking care of your mom, so hopefully the court sees that.
Just curious, how did your family even find out about the quit claim deed? Seems like they’re the ones stirring things up.

I honestly don’t know! My cousin must’ve told them. They’ve been in touch with the detective for like six months, making it all worse.

Families can be so intense sometimes… Hope everything turns out alright for you.
