Father Stated on Court Record He Wants to Waive Child Support in Michigan?

Guys, it’s been a rollercoaster lately. My ex and I have 50/50 custody of our 4-year-old and 2-year-old. In October, I had to report him to CPS and the police because I found belt marks on our older child. Now he’s facing third-degree child abuse charges.

Recently, we had a court hearing where I asked to suspend his parenting rights temporarily. He admitted to the abuse, saying he was just disciplining them. Even his girlfriend testified, admitting he went too far but insisted it wasn’t abuse.

After the judge ruled in my favor, he suddenly said he wants to terminate his rights, claiming he’s stressed out over all this court drama and is willing to pay child support. But the judge said he needs to file a petition for that.

Now, I’m wondering if I should file for sole custody or just leave it be. I doubt he’ll file anything since he hasn’t even filed motions for child support. What would you do in my situation? Thanks for any advice!

I grew up in the 80s and went through something similar with my grandmother using a belt and a switch on me. It was tough, and I still carry that trauma. I really hope your kids get the support and help they need through all of this. Sending lots of love :broken_heart:

In Michigan, a father can formally state in court that he wishes to waive child support obligations.
