So, I went to the beach with my family, had 2 cocktails, and about an hour later I was told by the meter lady to move my truck since it was in a loading zone. I moved it like 20 yards and then all of a sudden I got super confused and disoriented. I had no idea where I was and started panicking because I didn’t know where my passengers went. I called my fiancé freaking out and yelling at her, and then the call dropped. After a bit, an officer came to my window saying someone reported me arguing. He asked if I’d had anything to drink, and I admitted I had. They gave me a sobriety test and I failed. Later, I was told by a Kaiser nurse that I was probably going through ketoacidosis, which made me feel disoriented and panicked. I’m wondering if I should fight this DUI charge… any advice?
That’s a rough situation, but I think you might have a defense here. Diabetic ketoacidosis (DKA) can mimic symptoms of intoxication, like confusion and disorientation. It could be worth talking to a lawyer who knows about medical conditions affecting DUI cases. Did you get any medical records or a doctor’s note saying you were going through DKA?
@Drew
I haven’t got them yet, but I’ll definitely look into that. I didn’t think of that being an issue at the time, but now it makes sense. Thanks for the advice!
Sounds like you may have been experiencing something like hypoglycemia or DKA. Both can cause confusion and make you act like you’ve been drinking. If you were feeling that way, it might be worth challenging the breathalyzer results. Maybe it was a false positive? The officer could’ve mistaken your symptoms for being drunk.
@Olin
Yeah, I didn’t even think about the breathalyzer being wrong. I’ll definitely bring that up with a lawyer. Hopefully, they can help me figure this out.
That sounds pretty scary, especially if you were just trying to park and then got super confused. It’s possible that the confusion was caused by your medical condition rather than alcohol. I’d say definitely fight it, but get a lawyer who understands how your diabetes can affect things like this. It could make a huge difference.
@Teo
Yeah, I’m definitely going to find a lawyer who specializes in cases like this. I didn’t realize how much my diabetes could impact things like this.
This sounds like a tough situation, but it seems like you have a pretty good defense if your symptoms were caused by ketoacidosis or low blood sugar. You might be able to challenge the results of the sobriety test too, if your physical symptoms were from your medical condition, not alcohol. Definitely get medical records to support your case!
@Rex
Thanks for the advice. I’ll try to get all the medical records I can. It’s just been so overwhelming dealing with all this.
Ugh, that sounds stressful. If you were going through ketoacidosis, it could’ve affected your breathalyzer reading. Make sure to bring up your medical condition to your lawyer, they might be able to challenge the breathalyzer results. Also, it’s worth checking if the officer documented anything weird about your behavior or symptoms that could support your case.
@Rafe
Yeah, I’ll ask for the police report and see if they wrote anything about how I was acting. Hopefully, that’ll help me prove I wasn’t intoxicated.
