So, I got a citation for following too closely in Camden County, Georgia on August 23, 2024 at 9:48 PM. Here’s what happened: I was driving on I-95 when my low fuel light came on, and I needed to get to the nearest gas station. I was pulling a trailer, so my fuel was going fast. I made it to Exit 26, came to a stop at the sign, and waited for a car to pass. It was a patrol car, and when I pulled out behind it, I noticed the lights flashing. The officer said I almost hit his patrol car when I pulled out, but I was just trying to make it to the gas station before I ran out of gas. He then asked me about insurance on the trailer, but in Florida, insurance isn’t required for the kind of trailer I was towing. Anyway, I got the citation for following too closely and now I’m supposed to pay a fine and get 3 points on my license. I’m a firefighter captain, so I know the importance of safe driving, and I feel like this citation wasn’t deserved. Anyone been in a similar situation? Is it worth fighting it in court?
I had a similar situation once! The officer didn’t seem to understand that I wasn’t trying to rush, just needed to make it to the station. It’s a tough one to fight, but if you have the fuel receipt, that might help. Good luck!
@Dalen
Did you end up fighting it in court? What was the outcome?

Yeah, I ended up paying the fine. The judge wasn’t very sympathetic, but I at least had the receipt to show I wasn’t just being careless. It wasn’t worth hiring a lawyer for me.
That sounds rough! I think you could definitely argue it in court. The officer might have misunderstood your urgency to get gas. Having the receipt and the picture of the fuel gauge could work in your favor.
@Conley
I agree! If you can prove it was an emergency situation, you might get a better outcome. Just make sure to keep everything documented.
I’ve been in situations where I felt like I was just trying to be safe and avoid an accident, but the officer didn’t see it that way. It’s crazy that you’re being fined for this, especially with all the info you have!
@Haze
Yeah, it’s frustrating. I’m a bit confused though—how exactly does ‘following too closely’ apply in this case?

I think the officer thought I was tailgating when I pulled out behind him, but I was just trying to make it to the gas station before running out of fuel. It doesn’t really make sense to me either, lol.
I’d definitely look into getting a lawyer if you’re thinking of fighting it. They could help you get the best outcome, especially if you feel it was unfair. Most lawyers charge by the hour though, so just be ready for that.
@Dru
Yeah, I heard it can cost a lot. Does anyone know how much a traffic lawyer usually charges for something like this?

I’ve seen prices range from $200 to $500 an hour depending on the lawyer. It’s a lot, but if you really want to contest it, it might be worth it.
I think you have a pretty solid case if you decide to fight it. The officer didn’t seem to understand your situation, and having proof of the low fuel could be crucial. Make sure you gather everything before court!
@Rory
Thanks! I’m definitely going to make sure I have everything ready. I wasn’t planning to go this route, but it seems like it might be my best option.
