How can you give someone court papers in California?

Today, I tried giving some important papers to someone, but they locked their car and avoided me when I said I needed to give them the documents. I put the papers on the front of their car, but they fell when the person drove away. What should I do next?

After such behavior, all you need to do is try calling to explain and offer to meet to hand them the document safely. If no answer, leave a detailed voicemail and follow up with a certified mail copy for proof.

Given that you attempted to send the documents and the receiver did not accept them, please record your attempt along with any pertinent information and timestamps. If at all feasible, send a text or email to the receiver informing them of the occurrence and offering to resend the papers by mail or email, which are safer methods.

Sorry that you have had to undergo such an experience. Many people become (redacted) when they know that they are in the wrong.

In the future, you could employ the services of Court Process Servers. A lot of them are available all over California

Bring a friend over to your place and keep an eye on the neighbors’ residence. As soon as they walk out and are away from the door, have a friend run out and place the papers in front of them. Have a friend fill out proof of service and turn it up to the courthouse.

If the defendant cooperates and signs a notice and acknowledgment of receipt, you can send them copies of the documents and submit the signed notice instead of serving the summons and complaint the traditional method and then filing proof of service.
