How to remove a CIFAS marker... any advice?

Hey everyone, I need help figuring out how to remove a CIFAS marker against my name. It’s for first-party fraud (false instruments paid in and misuse of account), but I swear I’m innocent. I’m a victim of fraud myself, and my bank won’t budge. They say their actions weren’t unreasonable because fraudulent funds were involved. Has anyone dealt with this before? Any tips?

I’ve heard that once a CIFAS marker is placed, it’s tough to remove. Did you appeal their decision?

Yeah, I tried. The bank rejected it and said they acted reasonably. Not sure what to do next.

Did they give you any evidence of the fraud? Like, what makes them think you’re responsible?

They mentioned fraudulent funds being paid into my account but didn’t provide clear evidence. Just feels so unfair.

If they’re being vague, maybe try asking for a Subject Access Request? Could help you see what info they used to decide.

Have you looked into legal help? A solicitor might be able to help challenge the marker.

I thought about it but wasn’t sure if I could get one because of the marker. Do you think I’d qualify for no win no fee?

Pretty sure an IVA or CIFAS marker doesn’t stop you from using a no win no fee solicitor. Worth asking around!

They said I could go to the Financial Ombudsman, but IDK if that’ll actually help.

The ombudsman is worth a try. They’re usually good for holding banks accountable. Might take a while, though.

FYI, if you’re innocent, make sure you have all your documentation ready. It’ll strengthen your case.

Maybe any police reports or fraud alerts you’ve filed? That could help show you’re the victim.

Not sure. Does anyone know if CIFAS reviews cases independently?

They usually rely on what the bank says, but if you prove the bank got it wrong, they’ll remove it.
