I need to get custody of my nephews... any advice?

My 15 and 17-year-old nephews live with their biological uncle and aunt, who have had guardianship over them since 2020. They live in a different state than I do. I am also their biological uncle and have been involved in their lives since birth. We are very close, and I always knew they would eventually come to live with my wife and me. The biological parents are not in the picture due to addiction, and the boys want to move here with us. Do I need an attorney in my state or the state they reside in? I anticipate this will be a fight.

You need an attorney in the state where the kids live. You didn’t provide enough details to determine whether you have a strong case. If there’s no mistreatment, then you may not have a good case, but it could be worth paying for a consultation.

Do their current guardians disagree with what the boys want?

Why would this be a fight? Are you on different sides of the family? I’d recommend starting with a local attorney for a consultation to see what your options are. If the state is nearby, the attorney may be able to help with both states.

Unless you can prove there are significant issues in their current home, the kids will likely stay where they are until they’re adults.
