Hey everyone, I’m a Crisis Interventionist in Utah and I believe my employer is illegally withholding my overtime pay. I’m a non-exempt employee and usually work over 20 hours a shift, sometimes even 70-80 hours a week! My boss says overtime only counts when I’m with a client, calling the other hours ‘active hours’. I’m still on the clock when I travel, though. They even said they can’t pay overtime because it would hurt their business… if I report this, would I be owed back pay for all the hours they’ve refused to pay? Just wondering if filing a report is worth it.
You should definitely talk to an employment lawyer who specializes in overtime issues. Sounds like they’re violating the FLSA, and you could get paid for all those unpaid hours!
Yeah, they owe you back pay for sure! Plus, sometimes there are penalties added on top of that. It could be worth it to file a report.
I had a similar situation and it helped to keep detailed records of my hours. If you do report, having all that info can support your case.
I’d say definitely report it. If they’re saying they can’t afford to pay you, it’s likely they’re just trying to save money unfairly.
