If I get a chapter 9, will I still be able to buy firearms?

Hey, so I’ve been going through a Chapter 9 discharge process and was wondering if this will affect my ability to buy firearms. It’s still in the process right now, and I also self-enrolled in the SUDDC program. Does this affect my gun rights? Any insights would be appreciated!

I think it depends. A Chapter 9 discharge doesn’t necessarily affect your gun rights unless there’s something related to mental health or substance abuse involved. But since you voluntarily enrolled in the SUDDC program, it might not be a problem unless there’s an adjudication saying you’re mentally incompetent. It’s a good idea to check with a local lawyer to get all the details about how it affects you specifically.

@Lian
Yeah, it seems like that’s the main thing. I’ve read that voluntary treatment programs don’t automatically restrict your rights. You might want to consult with someone who specializes in this, though.

@Lian
Exactly, just make sure everything is clear with the state laws too, since they can differ from federal rules. Best to get the full picture.

If you’ve been self-enrolled, that’s good. It’s more about whether there was any formal mental health diagnosis or involuntary commitment. If not, it shouldn’t be an issue for buying firearms. But like others said, check with a local attorney to be safe!

@Cortland
I’ve heard the ATF does have an appeal process if you get a denial, so waiting and then appealing could be a solid plan. Just make sure you have all your documents ready.

@Cortland
Yeah, that’s true. You should also look at your specific state’s rules. Some states are stricter, so it’s worth checking those out too.

I think the main thing is the nature of your discharge. If it was just for failure to rehabilitate but not for any mental health reasons, you should be fine. But like others mentioned, checking with a local lawyer might be helpful. That’ll give you peace of mind!

Thanks for explaining all of that! So just to clarify, even though I was in the SUDDC program, if there wasn’t a formal mental health ruling or involuntary commitment, I should still be able to buy firearms in the future?

@stevemaguire
Yeah, pretty much. If there was no mental incompetency or involuntary commitment, you’re likely good to go, but it’s always better to double-check with someone who specializes in this stuff.

@stevemaguire
Got it, thanks for clearing that up! I’ll probably reach out to a local lawyer just to be extra sure.

Waiting 8 months and then trying the ATF appeal sounds like a decent option if you’re worried about it. They review each case individually, so that could work in your favor.
