I’m working on a Motion to Dismiss for a tenant who’s been lying about payments and filed a lawsuit right after a termination notice. Should I add details on all his bad-faith actions (like late payments, and false statements about paying), or will that make my motion too long and annoying for the court? Any advice?
Honestly, if it supports your main points, adding details might help. Just don’t overdo it, maybe?

That’s what I’m thinking… enough to show a pattern but not drown the court in details.

Yeah, try breaking it up with headings if it’s long. That way, it’s easier to follow.
Does the court know about the unpaid rent? They might appreciate clear proof if it’s missing from the record.
Just keep it organized! A long motion is fine if every part is clearly labeled and easy to follow.

If you’ve got solid proof, definitely include it. No judge likes a tenant dodging payments.
Was there any response from the tenant? They might just file a counter-motion if you hit too hard.

Nothing official yet, but I’m expecting something. That’s why I’m trying to cover all bases.

Probably smart to be prepared for that. Tenants will use any technicality they can.
If he’s filed the suit just to stall, make sure you explain that timing. It’s a common tactic.

Oh yeah, I’m definitely including that. Filed it 3 days after his termination notice.

That timing says a lot. Shows he’s not taking his obligations seriously.

Got it. I’ll add some headings to keep it clean and readable.

Perfect. That way, the judge won’t feel like they’re reading a novel lol.
