Is MMPI 2, update 2021 legal for military veterans who served in war?

I’ve been wondering if the MMPI 2 update from 2021 is even legal for military veterans who served in war. I took the test twice for an armed guard position in California, and now I’m hearing conflicting info. Anyone know about this?

I think the MMPI-2 is used for a lot of roles, like armed guards, but veterans are protected under USERRA, which stops discrimination because of military service. Could be worth checking if that was the issue in your case.

@Merrick
That’s right! USERRA protects veterans from discrimination, but if the MMPI-2 is being used to judge based on PTSD or something like that, it could be illegal. Might want to talk to a lawyer about it.

@Merrick
I didn’t know about USERRA before, thanks for sharing! That’s helpful info. I’d also check with a veterans’ rights lawyer to see if this situation applies.

Yeah, I’ve read that the ADA also stops employers from using disabilities, like PTSD, against veterans unless it directly affects their ability to do the job. If the test was used wrong, that could be a case for discrimination.

@Val
So if they didn’t explain why they denied you, that could be an issue? Sounds frustrating to deal with, especially after you served.

@Val
I’d be frustrated too if I was in your shoes. Maybe try getting the results of the MMPI-2 and see if they were used in a discriminatory way. You deserve some answers.

It sounds like you’ve got a strong case if they didn’t give you a reason. I’d recommend reaching out to a veterans’ lawyer to get advice on how to move forward.

Agreed! A lawyer specializing in employment law and veterans’ rights could really help you figure out if they violated any laws.

I’m going to follow up with a lawyer. They might be able to find something I’m missing. Thanks for the advice!

Sorry to hear about the denial. Did they give you any explanation for why you were denied? If not, it might be worth looking into how they used the MMPI-2 results.

No, they didn’t explain. I get the feeling they might’ve used the results to make assumptions about my service. I’m hoping to get more info soon.

That’s so frustrating. Hopefully you get some clarity soon. Don’t give up!

I totally get where you’re coming from. I’m dealing with something similar, and it’s tough not knowing exactly why things went wrong. Stay positive and keep pushing forward!

Thanks, OPQ! I’m staying positive and keeping track of everything. It’s been a lot, but I’m not giving up.

That’s the right attitude! Stay persistent and get support where you can.
