Hey everyone, I wrote up a contract for a tenant who wants to break their lease. Just wanted to get a second opinion on whether everything in it is legally valid in Hawaii. I know there’s a fee for a replacement tenant and other terms, but I want to make sure I’m not missing anything that could make it invalid. Any thoughts?

I’m not an expert on Hawaii law, but from what I know, the clause about returning the security deposit should be pretty solid. You’re allowed to withhold it for damages or breaking the lease early.

Yeah, makes sense. Just curious though, how often do people actually get a replacement tenant so quickly? I feel like it might take a while.

Honestly, it can depend. But if you’re proactive with the listings and marketing, it shouldn’t be too bad. Maybe offer a small incentive to speed things up?
