Master association suing my brother to evict us, what can I do?

Hi everyone, I’ve been renting a townhouse from my brother for 9 years and 3 months. The issue is, the master association is suing my brother to evict us, claiming he’s not supposed to rent his townhouse to me. I’m not sure where to start or what to do next. Do I need my own lawyer? Would love some advice.

That sounds rough. Did you get any formal eviction notice yet?

Not yet. Someone from the court came to our door to serve my brother, but he wasn’t here, so nothing was left. I looked online and found an open case with a court date though.

Wait, so you found the case online? Do you know if it lists you as a defendant?

Yeah, the case lists my brother and ‘unknown occupants.’ Not sure what that means for me though.

‘Unknown occupants’ usually covers anyone living there. You might want to prep just in case.

Do you have a written lease agreement with your brother?

Yeah, we have a written agreement. I’m just not sure if that helps in this situation.

It helps to show you’ve been paying rent properly. But the issue seems to be more about the association’s rules.

You might need a lawyer for this. Do you know if your brother is planning to fight it?

Not sure yet. I think he’s still figuring things out.

Yeah, a lawyer would probably be helpful for both of you. This kind of stuff can get complicated.

FYI, some master associations have really strict rules about rentals. Do you know why they’re saying he can’t rent it to you?

No idea. I guess there’s some rule in their agreement, but we didn’t know about it before.

Could be something like restrictions on renting to family members. You might want to double-check the HOA documents.

Just curious, what’s the next step for you? Are you planning to show up at the court date?

I think so, yeah. I’m just not sure if I need to hire my own lawyer or not.

It’s probably a good idea to at least consult one. They can tell you what your options are.
