My son's teacher got arrested for having meth in the classroom... can I sue the school?

So this happened at my son’s school: his teacher was arrested for having meth in the special education classroom. My son is nonverbal, and so are the other kids in the class. The drugs were apparently in the classroom while he was there that day. I only found out through the news and friends—the principal didn’t contact me until the following afternoon. My son had a rough time at ABA therapy that day, crying for 20 minutes with stomach pains and acting out of the ordinary. What are my options for suing the school for negligence?

Oh my gosh, that’s horrible. Did the school say anything about how the teacher was hired or their background?

Not yet. The principal just told me they’re investigating, but nothing specific about hiring checks or anything like that.

You might have a case for negligent hiring if they didn’t do a proper background check. Definitely worth exploring.

Did you take your son to a doctor about the stomach issues? That could help show how the incident impacted him.

Not yet, but I’m thinking about it. His behavior was so unusual that day.

I’d definitely do that. A doctor could help document anything related to the stress or exposure he might have had.

How did the school even allow someone like that to work with kids? Do you know if they had prior issues?

I have no idea. I’m waiting to hear more from the school, but they haven’t been very forthcoming.

If they didn’t vet the teacher properly, that’s a huge red flag. Definitely get legal advice on this.

I’d be furious if this happened to my kid. Did you talk to any other parents about what they’re planning to do?

A few parents are upset too, but I’m not sure if they’re considering legal action.

Maybe try to organize with them. A group complaint might carry more weight.

You mentioned your son is nonverbal. Are you worried he might have been directly exposed to the drugs?

That’s definitely a fear. He can’t tell me what happened, so I’m just left wondering.

So sorry you’re dealing with this. Definitely consult a lawyer—they can guide you through your options.
