Need help evicting a tenant without a lease, how long to give them?

Hi everyone! So, I have a tenant who’s been staying with me in Baltimore County, but we don’t have a written lease. I own the house and live here too, so we’re sharing the space. She’s been here for less than two months and hasn’t paid her rent in full. I want to evict her but not sure how much notice I need to give since there’s no formal lease. Anyone know what’s required here?

Hey! I think in Maryland you’re supposed to give 60 days’ notice for tenants without a lease. It’s a bit longer if you’re the landlord and they’re living with you.

Yep, landlord has to give 60 days, but if they haven’t paid, you might be able to shorten that with a 10-day notice.

If they owe rent, can’t you just give a 10-day notice? I think that’s what my cousin did.

She’s late but wants to pay before the 10 days are up… I just want her out though.

Gotcha, that’s tricky. If she pays, you might still have to give the full 60 days :grimacing:.

Yeah, the standard ones usually let you add terms. Look for a link to ipropertymanagement.com, they have some MD forms!

For a future lease, make sure you add a clause about rent due on the 1st, with late fees if they don’t pay on time.

That’s a good call. Can I set it up so they’re out by the 10th if they miss rent?

You could! There’s a standard MD lease that allows you to set up penalties and deadlines. Just search for ‘Standard Maryland Residential Lease Template.’
