My daughter was in an accident where another driver ran a red light and hit her. The officer didn’t take her statement, only the other driver’s, and the police report says she’s at fault. She had no insurance at the time (it had just lapsed), but there are cameras at the intersection, and traffic was heavy when it happened. Has anyone been in a similar situation? What should we do next?
That’s rough. I’d definitely try to get footage from the traffic cameras. That could prove what really happened.

Yeah, we were thinking of that. Do you know how we can request the footage?

Usually, you have to go through the police or your insurance company. But since there’s no insurance, maybe a lawyer can help?
Did she try to amend the police report? She can add her statement even after the fact, I think.

I didn’t know that was possible. How does she do that?

She just needs to contact the police department and explain the situation. They might let her submit her version of events.
Oof, no insurance makes this tougher. But if the other guy’s at fault, his insurance should still cover it, right?

That’s what I’m hoping. But the report saying she’s at fault might mess that up.

True. Maybe talk to his insurer directly? They might investigate beyond just the police report.

Were there any witnesses? Maybe someone at the school saw it happen.
We haven’t found any yet. Do you think it’s worth going back to ask around?
Wait, what’s MVCPA? Someone mentioned it to me before but IDK what it does.

It’s a Texas program that helps with costs when uninsured drivers are involved. Might be worth looking into.

Oh, got it. Thanks for explaining!
