Thank you for the A2A. I’m not sure I can contribute much to what has already been written here.

Nowadays, most police cars have dash cameras. Your lawyer should request the dashcam video. If you personally videotaped the interaction, you may also submit it.

The search and seizure are unconstitutional because, first, you did not consent to the search (if you did, sorry, but you’re done), and second, they did not have probable cause to search notwithstanding your objections.

If you can demonstrate that you did not consent to the search and that there was no probable cause to do it in the first place, a judge will likely rule that the search was illegal. But it all boils down to that ruling. Thank you for the A2A. I’m not sure I can contribute much to what has already been written here.

An illegal search and seizure of a vehicle occurs when police officers search your car or take items from it without following legal procedures. This can happen if officers unreasonably prolong the traffic stop or stop you without a valid reason.

If you are ever in such a situation, remember that you have the right to say no to a search, and you can challenge an illegal search later in court.
